Addiction itself is not a criminal offense. However, the desire to obtain drugs can contribute to criminal activities. Once in prison, an addict isn’t likely to be quickly assessed to determine if there criminal act was driven by their habit. A U.S. Department of Justice survey found that 1 in 4 violent offenders in a state prison were under the influence of drugs when they committed their offense. The Government Accountability Office noted a long waiting period for prisoners seeking addiction treatment while incarcerated, further highlighting a growing problem.
